What is a Misdemeanor?

Except in cases where a different punishment is prescribed by any law of this state, every offense declared to be a misdemeanor is punishable by imprisonment in the county jail not exceeding one year, or by fine not exceeding $1,000, or by both.

this is my first offense of petty theft, under 100.00, i was not taken to jail but given a ticket, can i just plea no contest? what should i do? and how long will this stay on my record, and what do you think i will get?

we got cought shoplifting i got a misdemeanor charge and is do to show up in court next week what should i do i have never done this and thisia my 1st ofense ever i have a good job driving school buses will this affect my employment there and if you know of any good lawyers that could help us into getting out of it i would apreciated

i was caught shop lifting a wallet that was $12 at macy's and all the security did was get my information and say that i just need to pay a fine and that's it. this was my first offense and i'm 18 years old. is this on my record? what are my chances of getting a decent job?

i was arrested for shop lifting and since it was my first offense they just kept me in jail until the finished all the paper work, and finger printed me then they told me that i need to appear to court by a certain date. now my question is, will this remain on my record and if yes for how long? will this affect me in getting a job or applying for school?? i am very worried and disappointed on my self. i would appreciate your help.

my son-in-law was arrested at his house last night ( had search warrant, his name wasn't on it, my daughters was )they took him to jail for 1 bowl of pot and 2 pipes, we don't even know why they took him, they said if they give them names this will all go away, he can't give what he doesn't know. his bond is $5,000. now they say they are going back 11 years to add these charges onto old ones he had that he didn't even do time for can they do this? we are in adams co. iowa

i have never been arrested and recently i applied to this job and they did a kroll background check on me and they called and told me that a felony charge came up on my background check. then the lady told me that the report did give a result for conviction or not. what does this mean?

so i got caught shoplifting from meryvens,but they didnt call the cops so its just a store ticket and the ticket is barely $34 or $4x this was in july and i havent paid my ticket yet if i pay it will this be wiped off my record????

i was caught shoplifting and they told me that they have been watching me for 2 weeks. i got a ticket that day by the cop but was able to go home that day. then a week later the cop shows up again with 4 more tickets. he said they looked me up on the cameras. my public defender said that if i plead guilty to 2 charges, 2 of them will be dropped. i have one on record now. she said i will spend 60 days in jail. will the judge suspend most of it or will i spend 60 days? it will be the 3rd charge of misdemeaner theft. they are all misdemeaners. what do i do?

i was arrested in the state of oregon for unlawful use of a weapon (having it in my hands, not pointing it at them) against two trespassors on my property. i had warned them verbally twice to leave my property on the second warning i also warned them i would get my gun. they didn't leave so i got the gun, then they left. it is my first offense, listed as a class a misterminor. i was arrested and stayed in jail over night, what will happen to me now (best and worst case)? i have a court date next month, should i get a lawyer? will this be on my record? if so, how long? will this stop me from getting a job in a major corporation? would something like this make me get negative results on a background check? if this goes on my record, will i be able to work for a security company still? please help me, i am new to this. i really didn't know that on my private property it is illegal to have a weapon out (showing them to scare them off) unless they were threatening my life. otherwise i wouldn't have done it.

so about nine years ago i wrote i bad check and went to court it was a class 1 mis. i just passed my insurance licensing board exam and they are doing a back ground check. i forgot all about it till i had to pull my record. will this charge show up and if so what will they do?

i was caught stealing a bra for about $12. the cops took me to the back of the store, he took down my information and left. i later received a subpoena in the mail. i went to court and had to pay a fine. i also had to go some classes and do community service. it was my first offense. will this be on my record? if so, how long? will this stop me from getting a job in a major corporation? would something like this make me get negative results on a background check?

i underreported the purchase of my minivan and received a note from the fl department and was found guilty of misdemeanor. i paid the fine. now i am applying for the green card (i-485). would that appear in my records and would be a obstacle fro getting the residence?

my husband and i wrote some bad checks in the state of kentucky, and he went to jail for 6 months. i was suppose to do 1 year when he got out, and then he'd come back in a do another 6 months. we have a kid, he was 6, so the judge set it up like that. well, i didn't show up to jail, i fled the state. my lawyer (who is now, 10/11 years later, the judge) told me the best thing i could do was get the hell outta dodge. so, i did. then, when my husband got out, he joined me. it's been 10/11 years and i would really like to be able to go back there, but i'm not sure if i can. do you think this has gone off my record there, or could i still be wanted? a few years ago my husband was put in jail and had a ncic done on him, and nothing came up. i don't know if they did one on me, but if there was nothing on him anywhere, would there be anything on me?

please let me know what you think

i was arrested in the nyc for petty thef misdormeaner but i don''t live there and i couldn't stay there due to a family issue back home in fl i was issue a desk appr.ticket at the police stn after i was finger printed is there anything i can do to avoid having a warrant being issued for my arrest and if not can they come to fl and get me if i have a warrant

i am currently going to school to become a medical assistant. i was wondering that because i recived a misdemeanor like 7 or 8 years ago, will it show up on a background check.... and if so.. is there a way to get rid of it? i no longer do any recreational drugs and am actually against it now. i just need to know so that when i go through school will this misdemeanor mess up my getting a job in the medical assistant positions that i will be aplaying for, if there is a way to be able to pay it off.... please let me know.. contact info is 239-323-0989 (home) or 269-841-3767 (cell phone)

im a business owner the nightly deposit came up missing ....so i check our cameras to see the whole theft . an ex employee who still stops in from time to time is the one to take the deposit, i call the police they see the video & issue a citation? i am furious! the entire deposit is considered grand larceny however crediit cards , checks make up a large portion so it is now petty because our laws have just changed. what can i do ?

i was caught with peti larsony. i went to court. the company made me sign a paper saying i stole 19,000 worth of stuff, i was young, didnt know what i was doing. anyway, so i was arrested, brought to court, had a high priced lawyer. needless to say i got it reduced to spitting on the sidewalk.

well almost 3 years later i try and get a job at a department store and they background check me, they tell me that it shows that i stole 19,000 worth of stuff from this company.

so even tho i wasnt convicted it still showed up on my background check.

does anyone know when/if that will ever come off???

ok i was charged with a hit and run against a kid..i never hit him he was at the front of my car and his other friend tried pullin me out so i decided to start accelerating to bout 10 mph and he was jus like sking on the fornt of my car(oh and this was all bout me getting jumped by them)..so he jumped outta the way the other dude who was trying to drag me out let go so i closed the door and i took off but my car spun around going around a turn so i headed back toward them i got stuck in the snow they confronted me and i told them i called the cops and then they left first so i dont get it and the kid i "supposedly hit" got a concussion which i dont get how so if anyone has any answers let me know!!!

i was in a fight two years ago back in arkansas. it was two on one (two of them against me). my friend broke up the fight. he resently got arrested for a warrant. he has been charged with 3rd degree battery. if he has been charged; i know that i also have a warrant. what should i do? is there a limit on the time they can charge me with anything? i now live in fl and do not plan on living in arkansas again for a long time but i do have my family there. the only time i go home is for family holidays.

the police did talk to me regsrding the fight shortly after it happened. i gave them my contact information and was more than cooperative. i was never charged.

i had the same situation, i was panic, same thing happened, my friend got cought shop lifting, the value of the items were like 20 dollars of jewelry at sears.

the security guys are sears were really jerks. so anyway, they called the police and the police took her to the police station where she was given a ticket to appear in court..

she went to court, when she got there, was was just asked if she how she pleaded. there you have two options, you can please guilty right then and on the the judge will give your sentence (something like community service or pay fine like $400 dollars) or your other choice is to get a public attorney.

if you choose to get a public attorney, they will give another date when you need to come back and make your plead with an attorney.

when you come back, you will talk to the public defender. explain to him your situation and be honest with him. he will plead a bargain for you. in my friends case, it was only $20 worth of crap that she took by mistake, so it was already ridicilous for the sear security to call the police (jerks) so the public defender plead bargain with the district attorney to lessen the accusation and change it from misdeminor to something else.

i rememeber the jerks at sears saying to her that she can always please no contest, but i dont know what tha means.

anyway, the whole expirience was a nightmare, specially for someone who's never broken the law and its afraid of breaking any laws. she was so afraid she was gonna de deported, so becarful. its important for everone to be good and learn from others. well, i hope this llittle story helped you get some idea of the process.

next time you try to steal something think twice about it.... or check your pockets before you exit any store. sometimes good people are forgetful and they forget stuff in their purses or pockets, it never hurts to check, because if you encounter jerks like those punks at sears, they will call the police and wont believe you even if you are honest about taking the items by mistake. i never go to sears now. never. well, once, but that was it!

hi, my friend was caught shoplifting at a grocery store, she took about 21.00 worth of stuff, i believe it was make up or something. she was ticketed and given a court date. just curious what we can expect. she is over 18 and this happened in washington state. any info on this would be helpful. she is terrified of going to jail, this is her first offense and she plans on pleading guilty and what not. should she get an attorney?

in south dakota can you be charged with petty theft if you were never stopped at the store nor did they ever retrieve the merchandise as evidence. they are going by a tape of me with a sack in my hand walking out the door

mom 19 year old son was arrested in lafayette, louisiana for shoplifting. he spent the night in jail and his bail was set at $750. he is in his first year of college in atlanta, georgia. can someone give me an idea of what is going to happen next. this is his very first time ever having a problem with the law. will he have to appear in court and how are out of state cases held?

my son, who just turned 18, hit a 12 foot split rail fence with our car on his way to work. he told the owner of the fence about it and was told "no problem". after he was done with work we decided the car was bad enough that it needed to get fixed and we needed a police report to file w/ insurance. so he called the state patrol. when we met up with him, about 10 hours after hitting the fence, the officer was very upset and told him he had a "hit and run". he has been charged with a 2nd degree misdemeanor. this is a kid that has never been in trouble w/ the law, has a 4.0 at the univ. in honor's physics, volunteers in the comm., etc. we have a letter from the owner of the fence obsolving my son and a estimate to get the car fixed but the d.a. won't even talk to us. should we hire a lawyer?

my friend, the age of 36, she has shoplifted with an amount of 420-450 dollars, it is her first offense, and she has no criminal record. she is required to go to court soon, and me and my friend want to prepare a good defense, so she doesn't go to jail or anything...and she is going to plead guilty, because she knows what she has done...and also, do you know the punishments for this? we live in michigan, and we just want to know if this is a misdemeanor or a infraction. please help us....this was an accident by the way, and she was on medicine and couldn't think straight help us please thank you!

i have an misdemeanor (traffic) decall was switch to another tag and driving on suspended license did not know my license was suspended, ticket was paid but i was still charge with a misdemeanor and can not get it spunge off which is stopping me from getting hired is there anything i can do to have it removed?

19 years old. this last week here in good o'l indiana cops came to where i was staying on a call that someone said there was pot being smoked...yeap we were, i took the rap for my my older bro & another family member. bond was $405.00 court date set for this friday, help me, what do i have to look forward to as far as punshiment?
